The use of marijuana for medicinal purposes is legal in Kentucky beginning January 2025. Marijuana for adult use is still illegal in Kentucky. The Food and Drug Administration (FDA) does not recognize or approve marijuana as medicine. According to the Drug Enforcement Administration (DEA), marijuana is a Schedule I substance under the Controlled Substances Act, meaning that it has a high potential for abuse. Overview
General Public
In order to apply for a medical marijuana card, applicants must be a resident of Kentucky; have a diagnosed, qualifying condition; have no prior felonies; submit a notarized form with an application; and pay an initial and annual fee. Adult cardholders will be required to have a written recommendation from one physician. Those under the age of 18 cannot possess or acquire without assistance from a designated caregiver and minor cardholders will be required to have written recommendation from two physicians.
Smoking is prohibited but raw marijuana (flower products) can vaporized. Vaping medical marijuana is allowable for those over the age of 21 in compliance with Kentucky’s T21 Law; however, vaping medical marijuana in public places in NOT allowed.
Industry
A recommendation made by a physician will be purchased at a dispensary. This is not a prescription medication, covered by insurance, to be filled at a pharmacy.
Marijuana businesses are exempt from sales and excise taxes.
For businesses that have applied and been granted the appropriate license, medical marijuana must be grown indoors. Home grown products by individuals are not allowed.
Local Policy
The City of Crittenden has prohibited the operation of cannabis business and industry within their jurisdiction via Ordinance 332-2024.
The City of Dry Ridge has prohibited the operation of cannabis business and industry within their jurisdiction via 900-2024.
